Standard Limited Warranty
Kysor Panel Systems division of Welbilt Walk-Ins LP (KPS) warrants this product against defects in material and workmanship under proper and normal use for the following:
Panels and Parts- one (1) year from original installation, but not
more than fifteen (15) months from date of shipment, F.O.B.
KPS factory.
Installation – if installation services are performed by KPS for
the original Purchaser/User, KPS warrants such services for
one (1) year from the date of original installation.
The obligation of KPS under this warranty is limited to repairing or replacing, at its election, F.O.B. factory, any part or panel that in the judgment of KPS is defective, provided KPS has pre-authorized in writing that a product be returned to it, transportation prepaid, for inspection and judgment. KPS assumes no responsibility for the expense of any labor or materials including labor necessary to remove a defective part or install repaired or new parts. This warranty does not cover a product, which has been subject to any accident, alteration, abuse, misuse, improper installation or operated contrary to the directions, instructions or recommendations of KPS.
This warranty is issued only to the original purchaser/user, is not transferable and is in lieu of all other warranties expressed or implied. KPS neither assumes nor authorizes any other individual or company to assume for KPS any liability not herein stated. The products’ refrigeration system and its component parts, which include the condensing unit(s), coil(s) and related accessories, is not covered by this warranty. KPS makes no representations or warranties of any kind for accessories or auxiliary equipment not manufactured by the KPS.
KPS shall not be liable for any damage or delays occurring in transit or for any default or delays in performance caused by any contingency beyond its control including war, government restrictions or restraints, strikes, short or reduced supply of raw materials, fire, flood or other acts of God, nor for damage or loss of any products, refrigerant, property or loss of profit due to malfunctioning of said unit.
The preceding paragraphs set forth the exclusive remedy for all claims based on failure of, or defect in, products or services sold, whether the failure or defect arises before or during the warranty period, and whether a claim, however instituted, is based on contract, indemnity, warranty, tort (including negligence), strict liability, implied by statute, common-law or otherwise and KPS its servants and agents shall not be liable for any claims for personal injuries or consequential damages or loss, howsoever caused. Upon the expiration of the warranty period, all such liability shall terminate.
THE FOREGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER WRITTEN, ORAL, IMPLIED OR STATUTORY NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE SHALL APPLY, KPS DOES NOT WARRANT ANY PRODUCTS OR SERVICES OF OTHERS.
This Limited Warranty shall be governed by the laws of the state of Delaware, U.S.A., excluding their conflicts of law principles. The United Nations Convention on Contracts for the International Sale of Goods is hereby excluded in its entirety from application to this Limited Warranty
